Caffeine and energy drinks: A case for action, or a storm in a can?
Barely a week goes by without a headline warning consumers about the dangers of energy drinks. However, whether these concerns are justified, and whether the FDA should take any action, is a matter for debate.
One food and supplement law attorney that has been following this issue closely - Justin Prochnow from the Denver office of law firm Greenberg Traurig - believes that the most likely action from the FDA (if any) will be a requirement for mandatory caffeine labeling (something which many firms have already started to do on a voluntary basis).
Meanwhile, the agency recently told us it is preparing to finalize guidance clarifying the dividing line between liquid supplements and conventional beverages and foods as the debate over the proliferation of caffeine-containing products intensifies.
